Media Sports Investments, the company who claim to own Carlos Tevez's economic rights, have issued a High Court writ against West Ham United.
MSI are trying to broker Tevez's proposed move to Manchester United, but the Premier League have insisted that West Ham must receive any transfer fee. The Hammers insist they still own Tevez's registration and that has led to the latest action from the player's representative Kia Joorabchian. Solicitor Graham Shear of lawyers Teacher Stern Selby confirmed in a statement that Joorabchian's companies MSI and Just Sports had launched a case against The Hammers. "I can confirm the companies (MSI and Just Sports Inc) have begun High Court proceedings against West Ham," said Shear. "This afternoon [Tuesday] a High Court writ was served on the football club's solicitors. "The companies seek the court's intervention to compel West Ham to release the registration of Carlos Tevez in accordance with contracts entered into between the parties. "We are asking the court to intervene so that Carlos Tevez can be registered to play with Manchester United as soon as possible." The whole Tevez saga was taken to Fifa last week and they ruled on Tuesday that the case would be best heard by the Court of Arbitration for Sport. MSI are desperate for the case to be resolved as soon as possible and they feel High Court action is the best avenue for them to take.

west Ham could emerge from the Carlos Tevez affair with several million pounds if an agreement is reached on an out-of-court-settlement.
Tevez's representatives Media Sports Investment are suing West Ham for £30million for breach of contract after they terminated third-party agreements regarding the player in April. However, it would suit all parties if a deal could be reached as a case in the High Court could take months to hear. Talks are continuing between the three parties to see if an agreement can be reached that would allow the Argentinian's move to Manchester United to go ahead before the start of the season. West Ham's lawyers have put forward a suggestion to the Premier League which would see the club receive a sum totalling several million pounds in compensation for agreeing to release Tevez's registration. The Premier League have to be satisfied that West Ham are receiving an adequate sum and chairman Sir Dave Richards, chief executive Richard Scudamore and general secretary Mike Foster spent several hours today discussing the proposal. The league have to be able to demonstrate to the other 19 clubs that they are operating under the scenario that Tevez's is contracted to West Ham and that the club are not controlled by the original third-party agreements that caused West Ham to be fined £5.5million by an independent disciplinary commission. The original contracts only contained agreements for West Ham to be paid £100,000 if Tevez moved on, but if the striker's agent Kia Joorabchian agrees to the settlement they could get around half the amount they were fined. West Ham have resigned themselves to losing Tevez but are keen to get an agreement rather than continue paying £1.75million annual wages for a player who will not turn out for them. |

West Ham are expected to announce on Friday that they have agreed a deal to release Carlos Tevez from his contract and registration.
The move will allow the Argentina striker to pursue a move to Manchester United. The agreement, which still needs to be formally ratified by the Premier League and Football Association, will see the Hammers paid between £1million and £3million in compensation. The deal will also mean the settlement of the £30million lawsuit brought against West Ham by Tevez's agent Kia Joorabchian. Talks ended with an agreement between both sides and the league and the FA should sign off the deal - Premier League lawyers have been kept up-to-date with the progress of discussions. Joorabchian should then be able to try to sew up an agreement with United to allow the striker to join up before the start of the season. In the unlikely event of either side having a last-minute change of heart, then the only other avenue would be a lengthy High Court battle and there has been an acknowledgement that that would be in no party's interests. Manchester United have already indicated a desire to take Tevez on the same sort of loan package that saw Argentina midfielder Javier Mascherano move to Liverpool last season. That deal took some weeks before it was signed off by the Premier League but with that transfer having already been picked over by the lawyers, a similar deal for Tevez should go through much quicker. The agreement with West Ham brings an end to a long-running and painful saga for the club that began when former chairman Terry Brown signed Tevez and Mascherano under banned third-party agreements last summer. The club were fined £5.5million as a result by a disciplinary commission in April and that led to an unsuccessful legal challenge by Sheffield United, who claimed they should have been docked points. |
